Terms of Use

1. Acceptance of these terms

The legal identity of SmartFit AI's publisher — company name, registered office — is being finalized in the legal notice. In the meantime, the Service is published under the name "SmartFit AI". For any question about these terms, write to us at support@smartfit-pro.tech.

2. License to use

We grant you permission to use SmartFit AI for personal, non-commercial purposes. You agree not to: modify or copy any element of the Service; use them for commercial purposes or public display; reverse-engineer any software component of the Service; remove any copyright notice; or transfer or copy these elements to another server.

3. User account

You agree to provide accurate, complete, and up-to-date information when creating your account, and to keep it current. You are solely responsible for keeping your login credentials confidential and for any activity carried out from your account.

4. Health and safety disclaimer

The training log, nutrition tracking, and AI coach are provided for informational purposes only: they are not a substitute for medical advice, diagnosis, or treatment. Consult a healthcare professional before starting a program, especially if you are pregnant, injured, or have a pre-existing medical condition. Physical activity carries inherent risks that you assume. To the extent permitted by law, SmartFit AI cannot be held liable for any injury or health issue resulting from use of the Service; this limitation does not exclude the statutory warranty, nor SmartFit AI's liability where its own fault is proven.

5. Subscription and payment

SmartFit AI offers a subscription (monthly, quarterly, or yearly) as well as a one-time recipe pack purchase; both are paid by card via Stripe, which never sends your card details to our servers.

Prices, the trial period, the right of withdrawal, and the terms for canceling or ending the subscription are described in the Terms and Conditions of Sale , which prevail in the event of any discrepancy with this section.

During the beta, all features that are normally paid are available free of charge to all testers (see the "Beta" section). They may become paid later on, with reasonable notice given within the app.

6. Social features and user content

You retain ownership of the content you publish on SmartFit AI (stories, club posts, messages, shared programs, photos, and so on). By publishing it, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and display it, solely to the extent necessary to operate and improve the Service.

The Service includes social features — friends, stories, clubs and their posts, challenges, messaging, and program sharing. You agree to only publish lawful content there and to treat other users with respect: hateful, sexual or illegal content, harassment and intimidation are prohibited. The first time you open the social area or messaging, the app asks you to accept these rules; without your agreement, you cannot access them. This content is not reviewed before it is published, apart from an automatic filter that masks a short list of abusive or hateful terms: we may remove, at any time and without notice, any content that breaches these Terms or the law, and suspend or close the account responsible for it.

You can report a user, a message or a club post from the app, and block a user: you no longer see their content and they can no longer write to you. We review reports within 24 hours; content that breaches these Terms or the law may be removed, and offending accounts deleted. If a piece of content bothers you or you think a mistake has been made, write to support@smartfit-pro.tech. The data processed when you report or block someone is described in the privacy policy (section 11).

7. AI coach and AI features

The AI coach is a feature built into SmartFit AI: by default, your questions are sent to an OpenAI model from our servers, not to a third-party assistant connected to your account. If you connect your own OpenAI or Anthropic API key in settings, that provider processes your messages instead of the built-in engine, at your own cost and using your key — see the privacy policy. The other AI features (programs, AI Photo, recipes, meal plans, fridge suggestions, reports, daily tip) also send data to an AI provider: all of them only open with your prior consent, which you can withdraw at any time with the "AI processing" toggle under Profile > Privacy & security; the privacy policy details what each one sends. The AI's replies are provided for informational purposes only and remain subject to the disclaimer in section 4: they are not a substitute for medical advice, diagnosis, or treatment. During the beta, use of the AI coach is limited to 10 questions per day, regardless of which engine is used. SmartFit AI is not affiliated with OpenAI, Anthropic, or any other artificial intelligence provider, and may modify, limit, or suspend this feature at any time.

8. Prohibited uses

You agree not to: violate any applicable law or regulation; transmit a virus or any malicious software; attempt to gain unauthorized access to an account, system, or network; disrupt or overload the operation of the Service; impersonate another person; or collect or store other users' personal data without their consent.

9. Intellectual property

The content, features, and operation of the Service — other than content you publish yourself (section 6) — are the exclusive property of SmartFit AI or its licensors, and are protected by applicable intellectual property laws.

10. Termination

We may suspend or terminate your access to the Service at any time, without notice, if you breach these Terms. Termination immediately ends your right to use the Service; it has no effect on the cancellation of your subscription, which is governed by section 5 and the Terms and Conditions of Sale.

11. Limitation of liability

To the fullest extent permitted by law, SmartFit AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, resulting from use of, or inability to use, the Service.

12. Minimum age

SmartFit AI is intended for people aged 18 and over. By using the Service, you confirm that you are at least 18 years old.

13. Beta

SmartFit AI is currently in beta: the Service is being tested, its availability is not guaranteed, and it may be interrupted, changed, or contain errors. Features that are normally paid are available free of charge to all testers during this phase; they may become paid later on, with reasonable notice given within the app.

14. Changes to these terms

We may modify these Terms at any time. You will be notified of any material change at least 30 days before it takes effect. Continuing to use the Service after that date constitutes acceptance of the modified Terms.

15. Governing law and disputes

These Terms are governed by French law.

Any dispute will be subject to the jurisdiction of the French courts under ordinary rules.
